In English and American law, and systems based on them, libel and slander are two forms of defamation (or defamation of character), which is the tort or delict of publishing (meaning to a third party) a false statement that negatively affects someone's reputation.
The First Amendment guarantees our right to petition our govern-ment and speak freely on issues and grievances. That does not give us a right to libel or slander
Unfortunately, many bloggers and webmasters think that their blogs or websites fall under the protection of the Ninth Circuit Court's ruling. This isn't so. If a blogger or webmaster posts libelous content that is original, it is still libel.
Internet users have been flaming others on the
Internet for years. Flaming means posting messages intended to insult and
provoke. In other words, someone posts a message for others to read which
insults and/or provokes readers against another person or company. People and
companies are now suing these posters and/or the Internet site
host for Libel and winning.
That means that ISP's are being held accountable along with site hosts.
